TERMS OF SERVICE

Effective Date: August 26, 2026

These Terms of Service govern your use of apexrenovationskc.com, operated by Apex Kitchen & Bath Renovations LLC (Apex, we, us, or our). By using the website, you agree to these terms. If you do not agree, please do not use the website.

1. WEBSITE PURPOSE

The website provides general information about Apex and its residential remodeling services. Website content is informational and may change without notice. Any project accepted by Apex will be governed by a separate written agreement describing the project-specific scope, price, schedule, payment terms, warranties, and other conditions.

2. SERVICE INQUIRIES AND ESTIMATES

Submitting a form, requesting a consultation, or communicating with Apex does not create a customer-contractor relationship, guarantee that Apex will accept the project, reserve a date, establish a schedule, or constitute a final estimate, offer, or construction contract. Website budget ranges, timelines, and examples are general illustrations. A proposal may change after a site visit, design development, measurements, selections, permit review, concealed-condition discovery, or a change in scope. No work is authorized until Apex and the customer enter an applicable written agreement.

3. COMMUNICATIONS

When you request contact, Apex may respond by telephone or email. If you select or consent to text communication, Apex may send one-to-one messages about your specific inquiry, appointments, estimates, and related service matters. Message frequency varies. Message and data rates may apply. Consent to receive texts is not a condition of purchase. Reply STOP to opt out.

4. INFORMATION YOU SUBMIT

You agree to provide accurate information and submit only content you have the right to share. You give Apex permission to use information, descriptions, documents, and photographs you submit solely as reasonably necessary to evaluate your inquiry, communicate with you, prepare an estimate, or provide requested services. Apex will not publish customer photographs or testimonials for advertising without separate permission.

5. ACCEPTABLE USE

You may not interfere with website security or availability, attempt unauthorized access, introduce malicious code, scrape or systematically extract content without permission, impersonate another person, or use the website for unlawful, fraudulent, or abusive activity.

6. INTELLECTUAL PROPERTY

The website and its text, graphics, logos, photographs, layouts, and other content are owned by or licensed to Apex and are protected by applicable law. You may view and print content for personal, noncommercial evaluation of Apex services. You may not reproduce, modify, distribute, sell, publicly display, or commercially exploit it without written permission.

7. EXTERNAL LINKS AND SERVICES

The website may link to third-party websites, maps, scheduling tools, payment services, social platforms, or other resources. Links are provided for convenience and do not constitute endorsement. Apex does not control and is not responsible for third-party content, availability, security, or practices.

8. WEBSITE DISCLAIMER

The website is provided on an as-available basis. To the extent permitted by law, Apex disclaims warranties concerning uninterrupted availability, freedom from errors, and the completeness or current accuracy of general website content. Project photographs, testimonials, examples, and descriptions do not guarantee identical results. Actual results depend on the property, scope, materials, site conditions, selections, and other project-specific factors. This disclaimer does not replace any express warranty in a separate written remodeling contract.

9. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Apex will not be liable for indirect, incidental, special, or consequential damages resulting solely from use of, inability to use, or reliance on general website content. Nothing in these terms excludes liability that cannot lawfully be excluded or limits rights and remedies provided by a signed project agreement or applicable consumer law.

10. PRIVACY

Our Privacy Policy explains how we collect and use information and is incorporated into these terms by reference.

11. GOVERNING LAW

These terms are governed by Missouri law, without regard to conflict-of-law principles. Mandatory consumer rights remain unaffected.

12. SEVERABILITY AND WAIVER

If any provision is found unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver of the right to enforce it later.

13. CHANGES TO THESE TERMS

We may update these terms as the website or our practices change. Revised terms will be posted with a new effective date.
